1. About these terms
1.1 This website at melanielansdown.com.au is owned and operated by Melanie Lansdown Nutrition, ABN 14 113 359 959, of Canberra, Australian Capital Territory. In these terms, "we", "us" and "our" mean Melanie Lansdown Nutrition, and "you" and "your" mean the person using the website or buying from us.
1.2 These terms cover two things: using this website, and buying our products and services. Please read them before you do either.
1.3 By using this website you agree to Part A. By buying from us you agree to Part A and Part B.
1.4 These terms should be read together with our Privacy Policy. If you enrol in a program, the Strong in Midlife Program Terms & Participation Agreement also applies, and where it differs from these terms in relation to the program, it applies instead.
1.5 If you do not agree to these terms, please do not use this website or purchase from us.
2. What we offer
Melanie Lansdown Nutrition provides:

Part A — Using this website
3. Information on this website
3.1 The content on this website is general information only. It is not personal advice and it does not take your individual circumstances into account.
3.2 Nothing on this website is medical advice, diagnosis or treatment, and it is not a substitute for care from your GP or another treating practitioner. Always seek advice from a qualified health practitioner about your own situation, and never delay or disregard medical advice because of something you have read here.
3.3 We are a nutrition practice. We do not diagnose medical conditions, and we do not prescribe or advise for or against medication, including menopausal hormone therapy.
3.4 We take care with our content, but we do not warrant that it is accurate, complete, current or suitable for any particular purpose. Content may change without notice.
3.5 You are responsible for how you use information from this website.
4. Acceptable use
4.1 You agree not to use this website for any unlawful purpose, or in any way that could damage, disable, overburden or impair it, or interfere with anyone else's use of it.
4.2 You agree not to:
attempt to access areas of the website not intended to be available to you;
decompile, reverse engineer, copy or imitate the website or its underlying content;
transmit any virus, malware or other harmful code;
send spam or conduct similar activity through the website;

5.1 We own the intellectual property in the content of this website, or use it with permission.
5.2 You may access, download and print material from this website for your own personal, non-commercial use.

6. Cookies, links and website availability
6.1 This website uses cookies. Our Privacy Policy explains what we collect and why. By using the website you consent to our use of cookies as described there.
6.2 This website sometimes links to other websites. We do not control them, we are not responsible for their content or their handling of your information, and a link is not an endorsement. You use them at your own risk.
6.3 We take reasonable steps to keep the website secure, but we cannot guarantee it. This website relies on third-party services and may be unavailable from time to time.
Part B — Buying from us
7. Prices and orders
7.1 Prices are in Australian dollars and include GST where GST applies.
7.2 We may change our prices at any time. The price that applies to you is the one displayed when you place your order.
7.3 Placing an order is an offer to buy. Your order is accepted when we confirm it, or when we give you access to what you have bought, whichever happens first.
7.4 We may decline an order. If we do, we will refund anything you have paid. We may decline where a service is not clinically appropriate for you, where we are unable to deliver it, or where there has been an error in pricing or description.
7.5 Where you buy more than one service together, you will be given an itemised quotation showing each component separately before you commit, and an itemised invoice afterwards.
8. Payment
8.1 Payments are processed by Square. We do not collect or store your full card details.
8.2 Your order is not accepted until payment has been received.
8.3 Where you pay for services in advance, we hold that payment on account for you and treat it as earned only once the service has been provided.
9. Digital products and downloads
9.1 Digital products are delivered by email or through your member portal at members.melanielansdown.com.au.
9.2 When you buy a digital product you receive a personal, non-transferable licence to use it for your own purposes. You may not share, resell, publish or distribute it.
9.3 You are responsible for having a device and internet connection capable of accessing what you have bought.
10. Consultations
10.1 Consultations are booked through our booking system and delivered by video or telephone unless otherwise agreed.
10.2 Before your first consultation you will be asked to complete an intake and health questionnaire and to sign an informed consent form.
10.3 Please give at least 24 hours' notice if you need to cancel or reschedule. A consultation cancelled with less notice, or not attended, is treated as delivered. We may waive this where the cancellation was due to illness or an emergency.
10.4 You must give us accurate and complete health information, and tell us if it changes. We rely on what you tell us.
11. Programs
11.1 Strong in Midlife is governed by the Strong in Midlife Program Terms & Participation Agreement, which you agree to when you enrol. Where that agreement differs from these terms in relation to the program, it applies instead.
11.2 Programs are offered to participants in Australia.
12. Testing
12.1 Pathology and functional testing is arranged only after a consultation in which we have considered whether it is appropriate for you. We do not sell testing as part of a prepaid package.
12.2 Testing is quoted and charged separately.
12.3 Testing is carried out by third-party laboratories. Once your order has been placed with the laboratory the fee is not refundable, because it has been paid to the laboratory on your behalf. We will tell you this before you commit.
12.4 We interpret results within the scope of nutrition practice. Results are not a diagnosis, and anything warranting medical review will be referred to your GP.
13. Your consumer rights, cancellations and refunds
13.1 Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies those guarantees or any other right you have that cannot be excluded.
13.2 For a major failure with a service, you are entitled to cancel and receive a refund for the unused portion, or to compensation for any reduction in value. For a failure that is not major, you are entitled to have it remedied within a reasonable time, and if it is not, to a refund of the unused portion.
13.3 Separately from your rights under the Australian Consumer Law, you may cancel a service you have paid for and not yet received, for any reason, and we will refund it in full. This includes unused consultations and coaching sessions.
13.4 Refunds are not available for services already delivered, for digital products already delivered to you, or for testing where your order has already been placed with the laboratory.
13.5 For programs, the refund provisions in the Program Terms & Participation Agreement apply.
13.6 Refunds are made to the original payment method within a reasonable time.
Part C — General
14. Privacy
14.1 We handle your personal and health information in accordance with our Privacy Policy, available at melanielansdown.com.au/privacy-policy.
15. Our liability
15.1 Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded.
15.2 Subject to clause 15.1, and to the extent permitted by law, our liability for a failure to comply with a consumer guarantee is limited, at our option, to:
supplying the services again; or
paying the cost of having the services supplied again.
15.3 Subject to clause 15.1, and to the extent permitted by law, we are not liable for indirect or consequential loss, or for loss of profits, revenue or opportunity.
15.4 We are not liable for loss arising from information you did not give us, or gave us inaccurately.
15.5 We are not liable for loss caused by events beyond our reasonable control.
16. Indemnity
16.1 You agree to indemnify us against any claim, loss, cost or expense we reasonably incur as a direct result of:

17.3 For anything you have already purchased, the terms in force at the time of your purchase continue to apply.
18. Complaints
18.1 If something has gone wrong, please tell us. Email [email protected]. We will acknowledge your complaint within 3 business days.
18.2 If we cannot resolve it, you may contact our professional association, the Australasian Association and Register of Practicing Nutritionists (AARPN), or the health complaints body in your state or territory. In the ACT that is the ACT Human Rights Commission.
19. General
19.1 These terms are governed by the law of the Australian Capital Territory. You and we submit to the non-exclusive jurisdiction of its courts.
19.2 Nothing in these terms creates a partnership, joint venture, employment or agency relationship between us.
19.3 If any part of these terms is invalid or unenforceable, it is severed and the rest continues to apply.
19.4 These terms, our Privacy Policy and (where applicable) the Program Terms & Participation Agreement form the whole agreement between us.
